    Gatorland 2010 Photo Contest Rules

    Contest Length:

    Gatorland's 2010 Photo Contest begins March 1, 2010, and ends August 2, 2010. All entries must be received by 5pm Eastern Time, Monday, August 2, 2010.

     

    Who may enter:

    Photographers ages 18 and over are eligible, except for those individuals affiliated with Gatorland, including stockholders, directors, employees, interns, volunteers, and their immediate families (children, siblings and spouses). By submitting an entry, each contestant agrees to the rules of the contest and states that they are 18 years old and older.

     

    Categories:

    The three (3) Gatorland 2010 Photo Contest categories are detailed below:

    Birds - This category is reserved for images of our feathered friends, both native and exotic. Gatorland is home to over 22 different species of wild Florida birds, as well as exotic species such as Lorikeets, Macaws, Parrots, Peacocks, and Flamingos. Whether it's one bird or a whole flock... if it has feathers it belongs here!

    Reptiles - What would a Gatorland Photo Contest be without gators? This category is not just for Gatorland's namesake alligators, but all reptiles found within the park including crocodiles, caimen, lizards, snakes, and turtles.

    Gatorland - This general category includes everything found at Gatorland except for birds and reptiles. Whether its animals, insects, plants, landscapes, architecture, or shows... this is the place for it!

     

    Prizes:

    The prizes for each of the three (3) Gatorland 2010 Photo Contest categories are:

    1st Place - $200 + Annual Photo Pass ($299.99 value)

    2nd Place - $100 + Annual Pass ($143.99 value)

    3rd Place - $50 + Single Day Photo Ticket ($79.99 value)

     

    Image Requirements:

    All photographs submitted must have been taken at Gatorland by the entrant within the past two (2) years (since January 1, 2009).

    For a photo in which a person is prominent and recognizable, you must secure a model release from the subject or, in the case of a minor, the subject's parent, and provide it to Gatorland upon request. The only exception to this requirement are those images that feature Gatorland employees. Photographs submitted that contain Gatorland employees do not require a model release for the employee.

    All entries must be submitted in digital high quality JPG format (please send original jpg file). File size for each image must be less than 10 MB. Scanned slides or prints are acceptable.

    Minor digital enhancement for cropping, red-eye removal, sharpening, brightness, contrast, and slight color adjustment are permitted, but images that have been excessively manipulated will be disqualified.

    Image entries may be submitted in color or black and white, and in either a landscape or portrait format. No watermarks, signatures, copyright info, borders or frames are permitted on images.

     

    Entry Fee:

    An entry fee of $5 is required per image submitted. There is no limit to the number of images that may be submitted.

    For your convenience, the entry fee may be paid online at our Gatorland Web Store.

    Current Gatorland Annual Photo Pass holders may submit two (2) images with no entry fee. Current Gatorland Annual Rookery Pass holders may submit one (1) image with no entry fee. To receive credit for your "free" entries, Gatorland Annual Photo Pass holders must include an image of the back of their Photo Pass showing name and expiration date. Entry credit is only for the individual Photo Pass holder, and is non-transferable.

    A portion of each paid entry fee will be donated to our local Florida Audubon chapter, Orange Audubon.

     

    How to enter:

    For your convenience, photographs may be submitted by email at photocontest@gatorland.com. We will also accept digital images on CD submitted through the mail.

    Please send all mail entries to: Gatorland 2010 Photo Contest 14501 South Orange Blossom Trail Orlando, FL. 32837. Gatorland is not responsible for any entries not received or lost in transit. CD's received will not be returned. Only digital images will be accepted, sorry no prints or slides!

    By entering the contest, entrants grant Gatorland a royalty-free, world-wide, perpetual, non-exclusive license to display, distribute, reproduce, and create derivative works of the entries, in whole or in part, in any media now existing or subsequently developed, for any Gatorland purpose, including, but not limited to exhibition, advertising and promotion of Gatorland and its Web site. Any photograph reproduced will include (whenever possible) a photographer credit. Gatorland will not be required to pay any additional consideration or seek any additional approval in connection with such uses.

     

    Judging:

    Submissions will be judged on content, clarity, composition and that special quality that makes an image a winner! Finalists will be notified of their status by September 1, 2010, and will be announced on the Gatorland Web site.

    This contest is void where prohibited or restricted by law. Gatorland reserves the right to cancel the contest or modify these rules at its discretion.

     

    Gatorland 2010 Photo Contest Bylaws


    LEGAL CONDITIONS:


    By entering, participants warrant that his or her entry materials are original, do not infringe on any third party's rights, and that the participant has obtained any necessary permissions from any third party if a third party or third party's property appears in the photograph. Gatorland reserves the right to disqualify any entry if it finds in its sole discretion that any of the foregoing warranties are not true. Decisions of Gatorland shall be final and binding.


    By entering, participants release and hold harmless Gatorland, its affiliated organizations, and each of their directors, officers, employees, attorneys, agents and representatives (collectively, the "Companies") from any and all liability for any injuries, loss, claim, action, demand or damage of any kind arising from or related to Gatorland, any prize won, any use of the entry materials by Gatorland, the warranties participants make, any misuse or malfunction of any prize awarded, or participation in any Gatorland related activity.


    The contest is governed by the laws of the United States and is subject to applicable federal, state, and local laws and regulations. Participant agrees that any and all disputes that cannot be resolved with the Companies, and causes of action arising out of or connected with Gatorland, shall be resolved individually, without resort to any form of class action, before a court of competent jurisdiction located in Orange County, Florida, which court shall apply the laws of the Commonwealth of Florida without regard for rules of conflicts of law. In any such dispute, participant shall, under no circumstances, be entitled to claim punitive, incidental or consequential damages, or any other damages, including attorney fees, other than participant's actual out-of-pocket expenses (if any) associated with participating in the Gatorland contest. Participant hereby waives all rights to have damages multiplied or increased.


    Any attempt by an entrant or other individual to deliberately damage any website or undermine the legitimate operation of Gatorland is a violation of criminal and civil laws, and should such an attempt be made, the Companies reserve the right to seek damages to the fullest extent permitted by law.


    The Companies are not responsible for any incorrect or inaccurate information, whether caused by website users or by any equipment or programming associated with or utilized in the Gatorland contest, or by any technical or human error that may occur in the processing of submissions to the Gatorland contest, including but not limited to any misprints or typographical errors. The Companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, photographs. The Companies are not responsible for any problems or technical malfunction of any telephone network or lines, computer equipment, servers, providers, computer on-line systems, software, or failure of email on account of technical problems or traffic congestion on the Internet or at any website, including injury or damage to participant's or to any other person's computer related to or resulting from participating or uploading images or information in the Gatorland contest.


    All federal, state, and local taxes, fees and surcharges on prize packages are the sole responsibility of the winners. Winners may be required to execute and return an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form. Return of any prize and/or prize notification as undeliverable or failure of any entrant to comply with any Official Rules may result in disqualification.


    If, for any reason, the Gatorland contest is not capable of completion as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Companies that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Gatorland contest, the Companies reserve the right at their sole discretion to cancel, terminate, modify or suspend the Gatorland contest.

     

    In no event will the Companies, their advertising and promotional agencies, or their directors, officers, employees, attorneys, agents and representatives be responsible or liable for any damages or losses of any kind, including direct indirect, incidental, consequential or punitive damages arising out of participant's access to and use of the Companies websites, or the downloading or uploading and/or printing of material from said sites. Without limiting the foregoing, everything on the Companies sites is provided "as is" without warranty of any kind, either express or implied. Some jurisdictions may not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the foregoing limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions.
